The rules in brief
- Notice and redundancy pay: The employer gives 1 month’s notice (10 days in some cases). Redundancy pay is 1 month’s average earnings with less than 5 years of service, 2 months for 5–10 years, 3 months for 10–20 years and 4 months after 20 years. It is subject to income tax but not to social insurance.
The legal notice is the same whatever the length of service: 1 month. (Labour Law s. 103)
These are the legal minimums. A contract or collective agreement can give longer notice.
